This paper is concerned with the description of the process of measurement within the context of a quantum theory of the physical world. It is noted that quantum mechanics permits a quasi-classical description (classical in the limited sense implied by the correspondence principle of Bohr) of those macroscopic phenomena in terms of which the observer forms his perceptions. Thus, the process of measurement in quantum mechanics can be understood on the quasi-classical level by transcribing from the strictly classical observables of (...) Newtonian physics to their quasi-classical counterparts the known rules for the measurement of the former. The remaining physical problem is the delineation of the circumstances in which the correlation of a peculiarly quantum mechanical observable A with a classically measurable observable B can result in a significant measurement of A. This is undertaken within the context of quantum theory. The resulting clarification of the process of measurement has important implications relative to the philosophic interpretation of quantum mechanics. (shrink)

Background: Informed consent in clinical research is mandated throughout the world. Both patient subjects and investigators are required to understand and accept the distinction between research and treatment.Aim: To document the extent and to identify factors associated with therapeutic misconception in a population of patient subjects or parent proxies recruited from a variety of multicentre trials .Patients and methods: The study comprised two phases: the development of a questionnaire to assess the quality of informed consent and a survey of patient (...) subjects based on this questionnaire.Results: A total of 303 patient subjects or parent proxies were contacted and 279 questionnaires were analysed. The median age was 49.5 years, sex ratio was 1 and 61% of respondents were professionally active. Overall memorisation of the oral or written communication of informed consent was good , and satisfaction with the process was around 70%. Therapeutic misconception was present in 70% of respondents, who expected to receive better care and ignored the consequence of randomisation and treatment comparisons. This was positively associated with the acuteness and severity of the disease.Conclusion: The authors suggest that the risk of therapeutic misconception be specifically addressed in consent forms as an educational tool for both patients and investigators. In 1952, Heinrich Scholz published a question in The Journal of Symbolic Logic asking for a characterization of spectra, i.e., sets of natural numbers that are the cardinalities of finite models of first order sentences. Günter Asser in turn asked whether the complement of a spectrum is always a spectrum. These innocent questions turned out to be seminal for the development of finite model theory and descriptive complexity. In this paper we survey developments over the last 50-odd years pertaining to (...) the spectrum problem. Our presentation follows conceptual developments rather than the chronological order. Originally a number theoretic problem, it has been approached by means of recursion theory, resource bounded complexity theory, classification by complexity of the defining sentences, and finally by means of structural graph theory. Although Scholz' question was answered in various ways, Asser's question remains open. (shrink)

Nous prendrons l’exemple de la consultation publique de la Communauté métropolitaine de Montréal et du budget interactif du Plateau-Mont-Royal pour illustrer les modèles de la gouvernance métropolitaine et de la gestion de proximité, pour ensuite montrer en quoi ces deux types de dispositifs participatifs soulèvent le problème de la trivialité. Nous soutiendrons enfin qu’une application systématique d’une conception (...) forte de la participation citoyenne, basée sur l’idéal de la démocratie participative, permettrait de surmonter le problème de la trivialité et d’opérer une véritable démocratisation des institutions municipales. | : This paper presents a critical analysis of the institutionalization of participation in Montreal at different levels. I will use the examples of the Montreal Metropolitan Com-munity’s public consultation and the Plateau Mont-Royal’s interactive budget to illustrate the models of metropolitan governance and local management, and demonstrate that these two forms of participatory mechanisms face the problem of triviality. I maintain that a systematic application of a strong conception of citizen participation, based on the ideal of participatory democracy, can overcome the challenge of triviality and effect a real democratization of municipal institutions. Some of my mental states are conscious and some of them are not. Sometimes I am so focused on the wine in front of me that I am unaware that I am thinking about it; but sometimes, of course, I take a reflexive step back and become aware of my thinking about the wine in front of me. What marks the difference between a conscious mental state and an unconscious one? In this paper, I focus on Durand of St.-Pourçain’s (...) rejection of the higher-order theory of state consciousness, according to which a mental act is conscious when there is another, suitably related, mental (reflex) act that exists at the same time with it. Durand rejects such higher-order theories on the grounds that they violate the thesis that a given mental power can have or elicit only one mental act at a given time. I first go over some of Durand’s general arguments for this thesis. I then turn to Durand’s application of the thesis to the issue of state consciousnes and reflex acts. I close by considering the objection that Durand’s same-order theory of state consciousness makes consciousness ubiquitous. (shrink)

Early modern philosophers, such as Descartes and Spinoza, appeal to a theory of modes in their metaphysics. Recent commentators have argued that such a theory of modes has Francesco Suárez as its primary source. In this paper, I explore one explicit source for Suárez’s view: Durand of St.-Pourçain, an early fourteenth-century philosopher. My aim will be mainly expository: I will put forward Durand’s theory of modes, thus correcting the persistent belief that there was no well-defined theory of modes (...) prior to Suárez. First, I will sketch out the historical and theological context in which Durand developed his theory, briefly canvassing some of the items that he treats as modes as well. Second, I will go over the distinctive features that Durand thinks modes have. Finally, I will close with some reflection on why we should countenance modes in our ontology. Along the way, I will correct a few misconceptions about Durand’s theory of modes. (shrink)

The present dissertation concerns cognitive psychology—theories about the nature and mechanism of perception and thought—during the High Middle Ages (1250–1350). Many of the issues at the heart of philosophy of mind today—intentionality, mental representation, the active/passive nature of perception—were also the subject of intense investigation during this period. I provide an analysis of these debates with a special focus on Durand of St.-Pourçain, a contemporary of John Duns Scotus and William of Ockham. Durand was widely recognized as a (...) leading philosopher until the advent of the early modern period, yet his views have been largely neglected in the last century. The aim of my dissertation, then, is to provide a new understanding of Durand’s cognitive psychology and to establish a better picture of developments in cognitive psychology during the period. -/- Most philosophers in the High Middle Ages held, in one form or another, the thesis that most forms of cognition (thought, perception) involve the reception of the form of the object into the mind. Such forms in the mind explain what a given episode of cognition is about, its content. According to what has been called the conformality theory of content, the content of our mental states is fixed by this form in the mind. Durand rejects this thesis, and one of the primary theses that I pursue is that Durand replaces the conformality theory of content with a causal theory of content, according to which the content of our mental states is fixed by its cause. When I think about Felix and not Graycat, this is to be explained not by the fact that I have in my mind the form of Felix and not Graycat, but rather by the fact that Felix and not Graycat caused my thought. -/- This is both a controversial interpretation and, indeed, a controversial theory. It is a controversial interpretation because Durand seems to reject the thesis that objects are the causes of our mental states. In the first half of the present dissertation, I argue that Durand does not reject this thesis but he rejects another nearby thesis: that objects as causes give to us ‘forms’. On Durand’s view, an object causes a mental state even though it does not give to us a new ‘form’. In the second half of the dissertation I defend Durand’s causal theory of content against salient objections to it. (shrink)

According to a standard interpretation of Aristotle, a material substance, like a dog, is a hylomorphic composite of matter and form, its “essential” parts. Is such a composite some thing in addition to its essential parts as united? The moderate reductionist says “no,” whereas the anti-reductionist says “yes.” In this paper, I will clarify and defend Durand of St.-Pourçain’s surprisingly influential version of moderate reductionism, according to which hylomorphic composites are nothing over and above their essential parts and the (...) union of those parts, where this union is explained by the presence of two modes: a mode of inherence on the side of form and a mode of substanding on the side of matter. We are affected by the world: when I place my hand next to the fire, it becomes hot, and when I plunge it into the bucket of ice water, it becomes cold. What goes for physical changes also goes for at least some mental changes: when Felix the Cat leaps upon my lap, my lap not only becomes warm, but I also feel this warmth, and when he purrs, I hear his purr. It seems obvious, in other words, that perception (...) (at least, and at least under ordinary conditions) is a matter of being affected by the agency of perceptible objects. Call this doctrine affectionism. Durand of St.-Pourçain rejects affectionism. The paper has three parts. In the first part, I sketch, briefly, what motivates Durand to reject affectionism. In the second part, I will take up the affectionist doctrine as defended by Durand's older contemporary at Paris, Godfrey of Fontaines, who holds that the object of all our mental acts (not just perceptions, but also thoughts and desires) is the efficient cause of those acts, or, in other words, all mental acts (not just perception) come about owing to the affection of the relevant mental faculty by the agency of the object. As it turns out, Godfrey develops a celebrated argument against the thesis that the object is not the efficient cause but a mere sine qua non cause. Hence his position offers a challenge to Durand's position, a challenge, I argue in the third part, Durand meets. (shrink)

Lawyers and the legal system have been much criticized in recent years. Despite popular perceptions, the legal system contains numerous mechanisms and rules designed to ensure fair results. This paper shows how the legal system tries to implement, in commercial transactions, the ethical principles of truthfulness and fairness. The Anglo-American development of Equity Courts is reviewed briefly. Several examples of the Law's enforcement of ethical principles are presented, in four different legal areas: Contracts, Securities, Goods, and Real Estate. The paper interprets Nietzsche’s description of authentic human person.Based on the works of Nietzsche, commentaries and philosophical interpretationsof various authors, authentic human person evolves into a superman by usingthe principles of discipline and mastery of oneself. His authenticity, however,requires persistence, courage and strength to endure many forms of sufferingsand to overcome alienation brought about by his environment. Otherwise,man would become slave of his desires or alien to his own powers, talents andcapacities. Thus, Nietzsche’s thought of superman is an invitation to (...) overcomeoneself, the self that is influenced by the non-self or factors outside one self. Itis only possible by using the will to power. The will to power of man overcomesthe influences of the world’s modernization and industrialization that alienateshim to his true self, and this true self is best expressed by his will to power. Onthis note, the author suggests that the readers must use their potentials to face up to challenges of this new era. The relation-theory of mental acts proposes that a mental act is a kind of relative entity founded upon the mind and directed at the object of perception or thought. While most medieval philosophers recognized that there is something importantly relational about thought, they nevertheless rejected the view that mental acts are wholly relations. Rather, the dominant view was that a mental act is either in whole or part an Aristotelian quality added to the mind upon which such a relation to (...) the object can be founded. In this paper, I examine Durand of St.-Pourçain's defense of the relation-theory of mental acts against two objections raised against it: the first from John Duns Scotus, among others, and the second from an anonymous Thomist and Adam Wodeham. -/- . Most philosophers in the High Middle Ages agreed that what we immediately perceive are external objects. Yet most philosophers in the High Middle Ages also held, following Aristotle, that perception is a process wherein the perceiver takes on the form or likeness of the external object. This form or likeness — called a species — is a representation by means of which we immediately perceive the external object. Thomas Aquinas defended this thesis in one form, and Durand of St.-Pourçain, (...) his Dominican successor, rejects it. This paper explores Durand's novel criticism of Aquinas's species-theory of cognition. I first develop and defend a new interpretation of Durand's central criticism of Aquinas's theory of cognition. This paper explores the origins of the term "causa sine qua non" used by Durand de Saint-Pourçain to describe the role of material things in knowledge. I show that its technical meaning comes from the Stoics and was transmitted to the Middle Ages by Boethius' commentary on Cicero's Topics. The expression "sine qua non" here does not have the ordinary and restricted meaning of "indispensable", "necessary condition", which can also apply to direct, per se causes of an effect. In (...) the present context, sine qua non causes do not act on the effect in question, either as concomitant, secondary, or instrumental causes, or as remote causes. They act only on that which hinders the actualization of a potentiality, in order to remove that obstacle. For example, the removal of a support that prevented something from falling does not act on that thing, nor does it add anything to its tendency to fall; it simply enables that thing to exercise its own actualization. Similarly, in cognitive processes, external things do not impose anything on the soul, but simply give it the opportunity to actualize its faculties of its own accord. I situate Durand's use of this form of causality in the context of late 13th/early 14th century theories of cognition, among several other attempts to find an alternative theory to the standard Aristotelian model and to maintain the pure activity of the soul with respect to the body. Wilderness valued as mere resource for human?interest satisfaction is challenged in favor of wilderness as a productive source, in which humans have roots, but which also yields wild neighbors and aliens with intrinsic value. Wild value is storied achievement in an evolutionary ecosystem, with instrumental and intrinsic, organismic and systemic values intermeshed. Survival value is reconsidered in this light. Changing cultural appreciations of values in wilderness can transform and relativize our judgments about appropriate conduct there. A final valued element in (...) wildness is its idiographic historical particularity, and most surprising is the emergence of a novel morality when humans learn to let values go wild. (shrink)

This study examines the use of a video news release in a specific story. Press coverage and editorial criticism in the case showed that journalists do not articulate sufficiently how the news owners' sway, through institutional controls, can lead to a hegemony of expedient action in the newsroom. Critical self-reflection by news workers will better enable journalists to ethically deliberate news choices that balance their responsibilities to owners, peers, and the public.

Many Christians treat marriage as a covenant. An influential group of contemporary Christians argues that covenant marriage provides a response to what they regard as the social ills of high divorce rates and the ‘breakdown’ of the traditional family. These Christians often look to John Calvin's marriage theology for inspiration because he linked treating marriage as a covenant to regarding marriage as sacred and indissoluble. In this article I cast doubt on the wisdom of treating marriage as a covenant. I (...) develop a critical genealogy that shows Calvin's marriage theology oppressed women by reinforcing their subordination to men and trapping women in abusive marriages. I then argue that recent social science suggests covenant marriage functions similarly among contemporary Christians. I consider whether a non-oppressive form of covenant marriage can be developed, before suggesting that we cannot yet know whether covenant marriage is salvageable. (shrink)

A set of constraints forces trade-offs which prevent us from achieving the best possible definitions of the ‘level’ and ‘unit’ of natural selection. This set consists in decisions concerning conflicting pre-analytic intuitions in problematic cases, the relative roles of various conceptual resources in the definitions, which facts need to be accounted for using the definitions, how the relation between selection and evolution orients the definitions, and the relation between the level and unit concepts. Systematic reconstruction and evaluation of leading analyses (...) along these dimensions favors a new functional analysis over Williams’ consequentialist analysis, Sober’s causal analysis, and Dawkins’ teleological analysis.
